2.1 Eligibility Requirements

To create an account and use GFC as a Game Creator, you must:

• Be at least 13 years old
• Have a valid email address
• Agree to comply with these Terms and all applicable laws
• Not be subject to sanctions or legal restrictions preventing service access

Players do not need to create an account to play games, and GFC does not impose or verify a platform-wide minimum age for players. Game Creators are responsible for ensuring that games they host are age-appropriate and that any parental or guardian consent required by law is obtained.

2.2 Account Responsibility

If you create an account:

• You are responsible for maintaining the confidentiality of your login credentials
• You are solely responsible for all activity on your account
• You must immediately notify us of any unauthorized access or account compromise
• You agree that your account may not be shared or transferred to others

2.3 Accurate Information

You must provide accurate, current, and complete information during signup. We reserve the right to suspend or terminate accounts using false or fraudulent information.

3.1 What We Provide

GFC provides:

• Cloud infrastructure to host and deploy games
• Credit-based billing system for game hosts
• Game creation and editing tools
• Player session management and analytics (optional, per game)
• AI-assisted text, quiz, photo analysis, and photo manipulation features where available

3.2 Service Availability

GFC services are provided "as-is" with no guaranteed uptime. We do our best to maintain service availability but make no guarantees. We may experience:

• Planned maintenance (with advance notice when possible)
• Unplanned outages
• Performance degradation

We are not liable for downtime or data loss (see Limitation of Liability, section 9).

3.3 Changes to Services

We may modify, suspend, or discontinue features or services at any time with reasonable notice. Continued use after changes constitutes acceptance.

4.1 Who Can Create Games

Any account holder can create and deploy games on GFC, subject to these Terms.

4.2 Intellectual Property Ownership

You Own Your Game Content:

• You retain full ownership of your game files, code, assets, and creative work
• GFC does not claim ownership of your game content

GFC Owns the Platform Concept:

• The underlying game concept, framework, and mechanics of the GFC system are owned by Games For Crowds or the game concept Author.
• You may not replicate, reverse-engineer, or commercialize the GFC system itself

4.3 Game Deployment & Moderation

Your Responsibilities as a Game Creator:

• Content Policy Compliance: Ensure your games comply with these Terms (no illegal content, no targeted harassment, no sensitive information)
• Player Safety: Do not require players to enter sensitive personal information (SSNs, payment details, medical data)
• Recommend Privacy: Inform players not to share private or sensitive information via your game
• Photo/Video Responsibility: You own all photos/videos captured in your games; you must comply with privacy laws and user consent requirements before using or sharing them
• Game Moderation: You are responsible for moderating in-game chat, forums, or player-generated content within your game; GFC does not moderate individual games
• Compliance: Ensure your game complies with all applicable laws (data protection, consumer protection, etc.)

4.4 Credit System & Billing

How Credits Work:

• You pay GFC per player-minute of gameplay
• Cost: 1 EUR per 1,000 credits (or equivalent in your currency)
• Each game has a variable credit rate set by GFC based on resource usage
• Billing is post-use: charges are calculated after players have used gameplay credits
• Invoices are generated at least monthly and charged to your Stripe account

Credit Examples:

• A 10-minute game costing 5 credits/minute = 50 credits = €0.05 per player
• A 60-minute game costing 2 credits/minute = 120 credits = €0.12 per player

Your Billing Obligations:

• You must keep your Stripe payment method current
• You are responsible for all charges incurred by your account
• Failed payments will result in suspension of your games
• You must notify us in writing within 30 days if you dispute a charge

4.5 Player Monetization

You Can Charge Players Yourself:

• GFC does not restrict how you monetize your games
• You may charge players, require subscriptions, or offer games for free
• You are responsible for payment processing and tax compliance
• You must clearly disclose any fees to players before they play

GFC Does Not Handle Player Payments:

• GFC only charges you for infrastructure costs
• Any payments between you and players are outside GFC's responsibility

4.6 Game Removal & Suspension

GFC may remove your game or suspend your account if:

• Your game contains illegal content, malware, or exploits
• Your game is used for harassment, hate speech, or abuse
• You fail to pay invoices
• You violate these Terms
• A court order or legal request requires removal

Notice & Process:

• For minor violations: We will issue a warning
• For repeated violations: We may temporarily suspend your games
• For serious violations: We may permanently ban your account
• For emergency safety issues: We may remove content immediately without notice

5.1 Playing Games

You may play games on GFC without creating an account.

Important Notes:

• Games are hosted by individual creators, not GFC
• GFC is not responsible for game content, mechanics, or quality
• The creator, not GFC, is responsible for moderation within their game

5.2 Player Conduct

As a player, you agree NOT to:

• Use harassing, abusive, or hateful language
• Spam or send unwanted messages
• Cheat, hack, or exploit game systems
• Interfere with other players' games
• Share other players' personal information without consent
• Attempt to access unauthorized parts of GFC or games

5.3 Photos & Videos

Consent & Usage:

• If a game captures your photo or video, the game creator is responsible for that content and for how it is used
• You should not participate in games that capture your image if you have privacy concerns
• The content will be automatically deleted 30 days after capture
• Do not enter sensitive information (real name, address, ID) into games unless you trust the creator

5.4 No Account Required

• You can participate in games without signing in
• You may use a pseudonym or nickname in games
• We do not require you to provide personal information to play

6.1 Legal Violations

• Post, upload, or share illegal content
• Engage in illegal activities or facilitate illegal conduct
• Violate any laws or regulations

6.2 Harassment & Abuse

• Harass, threaten, intimidate, or bully other users
• Post hate speech, discriminatory content, or slurs
• Doxx or share others' personal information without consent
• Send unsolicited sexual content or engage in sexual harassment

6.3 Spam & Exploitation

• Send spam, phishing messages, or scams
• Attempt to hijack or manipulate the Platform
• Create multiple accounts to bypass restrictions
• Use the Platform for commercial purposes unrelated to games

6.4 System Integrity

• Attempt to hack, reverse-engineer, or exploit the Platform
• Upload malware, viruses, or harmful code
• Access others' accounts without permission
• Use automated tools to scrape, crawl, or abuse GFC resources

6.5 Intellectual Property

• Upload content you don't own or have rights to
• Infringe on copyrights, trademarks, or patents
• Plagiarize or misappropriate others' work

7.1 Violation Process

Minor Violations:

1. First offense: Written warning via email
2. Second offense: Temporary suspension (24-72 hours)
3. Third offense: Extended suspension (up to 30 days)

Serious Violations:

Illegal content, child safety violations, or targeted harassment may result in immediate permanent termination without warning

7.2 Account Termination

GFC may terminate your account at any time if:

• You violate these Terms
• You engage in illegal activity
• Payment is not received
• You pose a safety or security risk
• Legal action requires termination

Upon Termination:

• Access to your account is revoked
• Your games are removed from the Platform
• Any unpaid invoices remain due
• Photos/videos and game data are deleted (except legal retention)

7.3 Appeals

You may appeal a suspension or termination by contacting [email protected] within 14 days. Include:

• Your account email
• Reason for appeal
• Evidence supporting your appeal

GFC will respond within 30 days.

8.1 User-Generated Content License

By uploading photos, videos, or other content to GFC, you grant us:

• The right to store, backup, and archive your content
• The right to process your content to provide requested gameplay and AI-assisted features
• The right to remove content if required by law or these Terms

You retain all ownership rights to your content.

8.2 GFC's Intellectual Property

All GFC trademarks, logos, code, documentation, and platform infrastructure are owned by Games For Crowds. You may not:

• Copy, modify, or reverse-engineer the Platform
• Use GFC's brand/trademarks without permission
• Create derivative products based on the GFC system

8.3 Third-Party Content

Games may include third-party assets, libraries, or code. Respect intellectual property rights and comply with applicable licenses.

9.1 Services Provided "As-Is"

The Platform is provided "as-is" without warranties of any kind, express or implied. GFC does not warrant:

• Uninterrupted or error-free service
• Fitness for a particular purpose
• Absence of viruses or harmful code
• Accuracy or completeness of information

9.2 Limitation of Liability

GFC's total liability for any claim is limited to the amount you paid to GFC in the 12 months prior to the claim, up to a maximum of EUR 100, to the fullest extent permitted by applicable law.

GFC is not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, lost data, or lost opportunity
• Third-party claims or actions
• Suspension or loss of access
• Damage caused by other users
• Game content or creator actions

9.3 Your Indemnification

You agree to defend, indemnify, and hold harmless GFC from any claims, damages, or costs arising from:

• Your use of the Platform
• Your violation of these Terms
• Your games or user-generated content
• Your infringement of third-party rights
• Your actions or omissions

9.4 No Warranty

We make no warranty that:

• Your games will be successful or profitable
• The Platform will meet your needs
• Service will be available during planned maintenance
• Your data will never be lost

10.1 Governing Law

These Terms are governed by Estonian law and EU regulations, specifically:

• Estonian Contract Law
• EU GDPR (for data processing)
• EU consumer protection regulations
• Other applicable EU directives

10.2 Dispute Resolution

Before Legal Action:

1. Contact us at [email protected] with a detailed complaint
2. We will attempt to resolve the dispute within 60 days
3. If unresolved, either party may pursue legal remedies

10.3 Jurisdiction

Both parties agree to submit to the exclusive jurisdiction of the courts of Estonia for any disputes.

10.4 Class Action Waiver

You waive the right to participate in class action lawsuits. Disputes must be resolved individually.

11.1 Credit Policy

• Gameplay credits are measured after use and billed post-use through your Stripe account
• You are responsible for charges generated by gameplay hosted through your account

11.2 Refund Requests

Refunds are not provided for:

• Gameplay charges validly incurred by games hosted through your account
• Dissatisfaction with games or gameplay
• Accidental credit usage

Refunds may be granted for:

• Fraudulent charges (within 30 days)
• System errors or overbilling
• Service failures (GFC's discretion)

11.3 Chargebacks

If you dispute a charge via Stripe or your bank (chargebacks/reversals):

• Your account will be immediately suspended
• You may lose access to your games and account features
• We may pursue legal action for chargeback fees and damages
• Future account creation may be denied
